German Courts Now Let Players Reclaim Losses From Unlicensed Casinos

October 18, 2026
Chicken-Road Play Now

Six German players just got a court order telling Tipico to hand their gambilng losses back, roughly 353,700 euros in total... , The Higher Regional Court of Stuttgart issued the six rulings on 9 and 12 October 2026, and as of mid October the claimants law firm has made the case numbers and amounts public. The logic is simple enough to fit on a betting slip... If an operator took bets from German residents without a German licence, the contracts were void, and void contracts mean the money goes back.

Three months ago the Dutch Supreme Court went the other way and told Dutch players they could not reclaim pre 2021 losses from PokerStars and PartyCasino. Germany has now drawn the opposite line, with the EUs top court behind it and the German Federal Court of Justice signalling it agrees. For anynoe who has ever deposited at an offshore casino, which in crypto means almost everyone, this is the ruling that matters.

What the Stuttgart court actually decided

Broadly, the six cases were appeals from district courts in Stuttgart, TΓΌbingen and Ulm.. Tipico had lost at first instance in each and appealed. The Higher Regional Court dismissed Tipicos appeals in every case and, in one of them, went furter than the lower court by adding sports betting losses the district judge had refused to award. , The claimants were represented by CLLB RechtsanwΓ€lte, whose lawyer Thomas Sittner summarised the outcome bluntly the rulings show players have good chances of recovering their losses.

Case numberPeriood of playProductsApproximate loss awarded
5 U 67/24April 2016 to February 2020Sports betting only181,000 euros
5 U 167/24August 2013 to March 2020Casino and sports betting46, 000 euros
5 U 108/24August 2013 to September 2020Casnio and sports betting42,700 euros
5 U 65/24December 2020 to December 2022Sports betting, casino, virtual slots38,000 euros
5 U 214/23May 2014 to March 2020Casino and sports betting26,000 euros
5 U 81/24August 2013 to June 2020Casnio and sports betting20,000 euros

The courts reasoning ran on three tracks. First, until 30 June 2021 online casino games were flatly banned in Germany, and Tipicos Maltese licence did not change that. Second, Tipico Co. Ltd only received its German sports betting permit on 9 October 2020. And the court refused to backdate it to the companys eariler application or to a claimed error in the licensing process. the permit also came with conditions, including a 1,000 euro monthly deposit limit, a ban on live and result bets and a ban on linking to other gambling sites. The court found Tipico had not complied, so a licence would not have been granted automatically anyway. Third, the slot licence for Tipico Gmeas Ltd only arrived on 6 October 2022, so slot bets taken between the new regimes start on 1 July 2021 and that date were void too. That last point is the one operators should read twice. The regulated market opening did not retroactively launder bets taken before the licence was actually in hand.

Why the Federal Court hearing matters more than the Stuttgart one

Stuttgart is one of 24 higher regional courts, and Tipico has lost similiar appeals in Cologne and Bamberg this year.. What makes October different is the timing. on 17 September 2026 the Federal Court of Justice in Karlsruhe heard the lead Tipico Games case, a player who lost about 10, 000 euros between 2020 and 2022, and designated it a model proceeding because of the sheer number of comparable claims sitting in lower courts. No judgment was handed down that day. The decisoin in case I ZR 216/25 is scheduled for 28 January 2027. from experience, Reporters in the courtroom described the senate as leaning toward the player on the central question: can losses be reclaimed when the operator had no German licence at the time? Lawyer Thomas DΓΌnchheim, speaking to Deutsche Welle, compared the trajectory to the Dieselgate mass claims and said the legal trend now favours consumers. The remaining battleground is wheather a player who knowingly gambled in a grey market can be accused of acting unlawfully too....... Stuttgart addressed that directly... Nothing showed the players knew the activity was prohibited or recklessly ignored it, so the defence failed.

The European backdrop sealed the exits. On 16 April 2026 the Court of Justice of the EU ruled in the Lottoland case (C 440/23) that Germany was entitled to ban onine slots and lottery betting even for operators licensed elsewhere in the EU, that contracts for banned services can be voided under national law. and that a players choice to gamble on a foreign licensed site is not an abuse of rights.. A separate referral from the Federal Court, case C 530/24 on Tipicos sports betting, drew an Advocate General opinion in March 2026 saying an operator wihtout the required national licence may have to refund stakes unless the licensing failure was purely procedural. , That carve out is exactly what Stuttgart rejected on the facts.

How far back can German players claim

This is where the Stuttgart judgments do real damage to operator balance sheets..... The court held that the online gambilng ban is a protective statute. Which means the limitation period runs for ten years under section 852 of the German Civil Code rather than the standard three..... Several of the six cases reach back to August 2013. A player who lost money on an unlicensed site in 2016 is still inside the window.

The court also waved through third party litigation funding, which is the engine behind the volume. Funders such as Gamesright claim to have processed over 100,000 affected players, and estimates of total operator exposure in Germany alone start at aorund a billion euros. Those are industry and funder figures, not court findings, but the direction is not in doubt... law firms are now bundling claims into group actions ahead of the January ruling.

Germany versus the Netherlands, same question, opposite answer

The contrast with the Dutch Supreme Courts 3 July 2026 decision could not be sharper.... Both countries had no licensed onlne casino market until 2021. Both had players losing six figures on Malta licensed sites. The Dutch court held that the prohibition targeted the operators conduct and did not reach into private contracts, so the bets stood and Entain kept the money. The German courts hold that the ban is a protective statute, the contracts are void, and the operator has to give it all back. Two EU neighbours, two Malta licensed operators, two opposite outcomes, and after Aprils CJEU judgment both approaches are legally permissible..... National law decides. But Austria is closer to the German camp and has gone one step futher. following the CJEUs January 2026 Wunner judgment. Which held that restitution claims against unlicensed operators are governed by the law of the players home country, Austrias Supreme Court confirmed that company directors can be personally liable for player losses when tort law is breached. maltas Bill 55, which shields Malta licensed operators from enforcing foriegn judgments, is already under EU infringement proceedings. the shield is thinning.

What this means for crypto casinos taking German players

Tipico is a licensed, listed, European operator that eventually did get its German permits. The six players still won. now consider the operators that never applied. The GGL, Germanys federal gamblng regulator, publishes an official whitelist of permitted gambling operators, last updated on 2 October 2026. If a casino is not on it and accepts a German resident, every euro that resident loses is, on the Stuttgart reading, repayable for a decade.

The regulators own study puts unlicensed gross gaming revenue in Germany at 547 million euros in 2024, up 17 percent on the year before, and a Handelsblatt Reseach study argues the black market share of online play now exceeds 50 percent..... A large slice of that goes through Curaçao licensed crypto casinos.... One financial crime outlet has already started mapping Germany facing payment routes behind Curaçao operators such as Dama N.V... and Hollycorn N.V. and asking whether they are next. , The rulings do not touch platfom suppliers, and nothing in them establishes liability for a technology provider. But the operator that signed the player up is squarely in scope. on the other hand, The practical obstacle is enforcement rather than law. A German judgment against a Curaçao company with no European assets is a piece of paper until someone finds something to seize.. that is why Austrias director liability line matters, and why calim funders are increasingly targeting payment processors and the people behind the licences rather than the shell entities.... Crypto deposits complicate recovery in one direction and simplify it in another. On chain records make the deposit history trivial to prove, which is the part of a refund claim that usually fails.

What players should take from the ruling

At first glance, if you are a German resident who lost money on an unlicensed site at any point since late 2016, the October rulings say you have a live calim and a ten year clock....... Keep deposit records, wallet addresses and transaction hashes. The claim funders will take a cut, usually a third, but they carry the cost of losing. Everyone else should treat this as a preview. The CJEU has made clear that each member state can choose the German model, and litigation funders now have a profitable template to push into every makret that does.

For operators, the cleanest defence is the boring one: do not take players from markets where you are not licensed... Some crypto platforms have been quietly tightening geo blocking for exactly this reason. CryptoCasino.Vegas, for instance, screens player jurisdictions at signup rather than waiting for a withdrawal to trigger the check. Which is the only sensible posture when a decade of deposits can be reopened by a single ruling... The German courts have turned unlicensed access from a compliance risk into a refund liability, and Januarys Federal Court decison is about to say so in writing.
